We/ Speak2Me are an internet-based mobile application developed and operated by Expert G3nii technologies Limited Liability Partnerships and this document uses the terms “we”, “our”, and Speak2Me interchangeably. The terms “you” and “users” are also used interchangeably. The term “we” refers to both the app and the company, wherever context permits.

 

How We Work

Speak2Me offers emotional support through curated conversations with trained listeners, accessible through our mobile application. Some features are available in exchange for a recurring fee (the “Membership Services”). Your use of these services constitutes acceptance of these Terms of Service.

By downloading or using our app, whether via an app store or any other method, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service, as well as our Privacy Policy, which is incorporated by reference.

These Terms are governed by the laws of India and fall under the jurisdiction of, India.

Proceeding to use the app is an indication that you accept the terms and that this document constitutes a legally binding agreement.

 

Nature of Our Service

  • Our platform connects users with individuals we refer to as “listeners”.
  • These listeners are not medical professionals, therapists, or counselors. They are in empathetic listening and are present to offer emotional support through non-therapeutic discussions.
  • We perform basic vetting of listeners but do not guarantee the accuracy of their personal or professional disclosures.
  • Listeners are not employees of Speak2Me They are independent contractors or third parties responsible for their own conduct and statements.

 

Important Disclaimers

  • We are not a substitute for professional mental health care. If you are in crisis or need clinical assistance, we urge you to contact emergency services or a licensed professional.
  • Conversations are anonymous to the extent technologically possible, but we encourage users not to share identifiable or sensitive information.
  • We are not liable for any disputes, conflicts, or harm (emotional, financial, legal, or otherwise) arising from your interaction with a listener. You agree to indemnify us fully against any claims arising from such interactions.
  • No conversations or suggestions should be interpreted as medical, legal, or professional advice.

 

User Responsibility

  • You are solely responsible for your behavior, decisions, and any consequences thereof arising from using this platform.
  • You agree not to misuse the platform or engage in any illegal, harmful, or offensive behavior.
  • You agree not to form relationships outside the platform with listeners and not to record or distribute conversations.

 

Service Availability and Modifications

  • We may change, suspend, or discontinue any part of our services at any time, without prior notice.
  • We may remove content or modify features based on legal or policy requirements.
  • We reserve the right to modify these Terms from time to time. Continued use of the service indicates your acceptance of the updated Terms.

 

Anti-Hacking Policy

You agree not to:

  1. Violate laws or regulations in using the app.
  2. Use bots, scripts, or scraping tools to access or interact with the app.
  3. Attempt unauthorized access or disrupt services.
  4. Record or distribute conversations from the app without consent.

Violation of any of the above may lead to termination of your account and potential legal action.

 

Force Majeure

We are not liable for service disruptions due to natural disasters, governmental action, or other circumstances beyond our control.

 

Fees and Payments

  • All paid services must be settled in advance. We do not offer price protection or refunds for promotional changes.
  • For international users, applicable taxes, currency exchange fees, or bank charges may apply.

 

Content and Communications

  • Some content may be sensitive or offensive to certain users. Use discretion.
  • By signing up, you consent to receive emails and messages related to service updates, promotions, and feedback requests.

 

Limitation of Liability

You agree that any damages or liabilities related to your use of the app will not exceed the amount paid by you for the service. We are not liable for indirect, incidental, or consequential damages of any kind.
